A Judge In Seattle Just Blocked Trump's Travel Ban

Submitted by: fancylad 1 month ago News & Politics

Federal judge James Robart of Seattle, Washington just granted a nationwide temporary restraining order. It blocks Trump's recent executive order which banned anyone coming into the United States if they were from one of seven countries cited in said order.

In reaction to the news, Washington State Governor Jay Inslee told The Seattle Times, "No person, not even the president, is above the law. We should feel heartened by today’s victory and more resolute than ever that we are fighting on the right side of history."

The (8 U.S. code 1182)"Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate" that's part of the code Trump used what part is unconstitutional seeing as its been on the books so long and there have been other times that very specific persons have been banned. The Chinese Exclusion Act of 1882, in 1924, President Calvin Coolidge signed the Johnson-Reed Act, which limited the number of immigrants coming to the U.S. while completely barring Asian immigrants. So what part of what Trump did is Illegal? And again its not a ban on Muslims because it does not ban the people from the other 50 or so predominantly  Muslims countries. squrlz4ever    As far as monkwarrior goes he is just a troll and you are right he should watch what he is saying, the Secret Service even interviewed Cher I think about her woman's march speech.

casaledana - Time for a civics lesson.  Using the U.S. Code as evidence that any law is constitutional is incorrect.  The Constitution is the supreme law of the land.  So, just because something is in the U.S. Code, even if it is there for a long time, does not mean that it automatically passes the Constitutional test.  The Constitution overrules any laws that are in conflict with it, as decided by the Supreme Court.  The final decision has yet to be made on this particular case - but for now, there is a valid challenge that the muslim ban is unconstitutional - and this likely will be decided in the US Supreme Court.

A side note: The previous acts (Chinese Exclusion Act and Johnson-Reed Act) were either repealed or revised.  In both cases, however, they resulted in strained relations with the affected countries - and in at least one case, was arguably a contributing factor in a later declaration of war.

theman01 Interesting observation, especially since the Bush's have said nothing positive about Trump and quite frankly understand more than anyone why he is dangerous.  Maybe this judge is doing his actual job and upholding the law.  Now that is the scary thought ;)

monkwarrior Monkwarrior, are you aware that saying or writing those words could earn an American a visit from the Secret Service?

I really don't understand your motivation here. Do you want to do away with the presidency as an institution? Then why not "Abolish the presidency"? Or are you advocating something more violent and specific?

Hard to know exactly what your position is. You're an odd combination of adolescent teen bluster and evasiveness. I've asked and you won't even tell me what country you're from. Weird, frankly.

squrlz4ever I'm well aware, but not the slightest bit worried.  Gather in growing numbers, chant those 4 words over and over, and you will eventually have the change you want.

monkwarrior Annnnnd again, you've declined to answer my questions.

For someone who constantly urges others to put their necks on the line, you sure play it safe when it comes to yourself.

squrlz4ever Well didn't you just imply i was putting my neck on the line?  If your neck is on the line would you waste time with questions the asker could easily look up in a dictionary? :D

NO one is above the law except Obama when he over wrote law by instructing not to enforce immigration law by not prosecuting illegals that were children or been here along time which opened the door to millions of children attempting and getting in to the U.S.

casaledana actually...this is the most ridiculous statement I have read today...

Seriously, if you do not understand why he felt protecting children from returning to a war torn country run by drug lords and provide them a chance at life, liberty and the pursuit of happiness...the American Dream...then you don't understand what America is supposed to be.

rumham  I am not afraid of a child but I am afraid of the adults that have been coming into this country willy nilly for years. And I am afraid of people that don't understand that if Trump is breaking the law so did Obama, and you didn't seam to care then, Obama was not enforcing the laws of the U.S. he was circumventing them, and you call Trump king, what was Obama, Queen? Trump is trying to secure our border and enforce the law of the land which every other country does.

taxidriver  Weather Obama is in office or not does not change what he did and what Trump is trying to do. And according to the likes of you Obama didn't do anything wrong, He used his executive power to get around the law, Where as Trump is using his executive power to enforce the law. And if you make a wrong  then a right it brings you back in the proper direction.
